Laws setting up the Commission
EDO STATE OIL AND GAS PRODUCING AREAS DEVELOPMENT COMMISSION
There is hereby established a body to be known and called Edo State Oil and Gas Producing Areas Development Commission.
The commission consists of:
a) The chairman who shall be an indigene of an Oil and Gas producing Area of the State.
b) Three (3) representatives of the Oil and Gas Producing Areas of the State.
c) Three (3) members one each representing North; Central and non Oil and Gas Producing part of Southern Senatorial District of the State.
d) Three (3) Ex-officio members representing:
i. Ministry of Finance, budget and Economics Development.
ii. Ministry of Environment and Solid Minerals.
iii. Ministry of Works.
I. The people shall have its head office in Benin City; and
II. Area Office at an Oil and Gas producing Local Government Councils in the State.
The chairman and other members of the commission shall be appointed by the Governor subject to ratification by resolution of the House of Assembly
The chairman shall be the chief executive officer of the commission and shall hold office for a period of (four) 4 years and may be re-appointed for a maximum of two terms.
All Ex-officio members of the Commission shall hold office during their tenure in office.
The representative of the Oil and Gas Producing Areas and other three (3) representatives mentioned in section 4 (c) shall be on full time basics; hold office for a period of four (4) years and may be re-appointed for a maximum of two terms.
“There shall be paid to the Chairman and Members of the Commission such renumerations, salaries and allowances as applicable in other Commissions in the State”.
The supplementary provisions as contained in the schedule to this law shall have effect with respect to the proceedings of the Commission and the other matters contained therein.
The office of the Chairman and or a member of the Commission other than the Ex-officio members shall become vacant if;
i. He resigns his membership by notice in writing to the Governor.
ii. He is adjusted or declared bankrupt under any law in force in any part of Nigeria;
iii. He has absented him self from three consecutive Board meetings of the Commission without a written permission;
iv. He is disqualified by any law in force in the State;
v. He is removed from office by the Governor on ground of misconduct subject to ratification by resolution by the house of Assembly.
FUNCTIONS OF THE COMMISSION
The Commission Shall;
i. Receive into its account and administer exclusively 40% of the 13% oil derivation fund accruing to the Edo State Government for;
a) The development of Oil and Gas Producing Areas in the
ii. Liaise with the relevant Federal government and State Government authorities on the control and effective methods of tacking the problems of coastal erosion, Oil and Gas pollution, spillages and other environmental problems in the State.
iii. Ensure fair and equitable distribution of developmental projects in the Oil and Gas producing areas of the State.
iv. Ensure the judicious utilization of the fund accruing to the Commission
v. Enlighten the communities in the Oil and Gas producing areas of the State on the functions, policies and activities of the commission;
vi. Execute such other works and projects and such other functions which in the opinion of the commission are necessary for the sustainable development of the Oil and Gas producing areas of the State;
vii. Liaise with the Oil and Gas Prospecting Companies Operating in the Oil and Gas producing areas of development of the Oil and Gas Producing areas of the State;
viii. Liaise wit Niger Delta Development Commission for the overall development of Oil and Gas producing areas of the State.
THE POWER OF THE COMMISSION
i. Manage and supervise the affairs of the commission;
ii. Enter into contract as may be necessary or expedient for the discharge of its functions and ensure the efficient performance of the function of the Commissionin accordance with the government financial regulations
iii. Establish and maintain such number of departments as it may deem fit for the effective discharge of its function;
iv. Pay the staff of the Commission such renumeration and allowances as appropriate;
v. Make rules and regulations for carrying out the functions of the Commission;
vi. Do such other things as are necessary and expedient for the efficient performance of the functions of the Commission. |
